UK sellers on WA will need to gross £283 to break even (and that's assuming that they didn't incur cost getting the whisky to WA in Perth). I think that most will turn a gain by Monday night. |

They're under Collectables/Whiskey bottles - which should be empty. Perhaps I'll drink my bottle, list it on ebay and collect my £1k ! Happy days. |

i dont think they know that they were supposed to be empty most people dont know the rules
or do any research they see whisky for sale on ebay and think its okay to sell
shpock gumtree and preloved all have the same problem |

I would think some whiskies are listed as buy now and sell before ebay spot them. |

True. If they do know what they're doing they need to list it as "Buy it Now" not on a 7 day auction. More chance of shifting it that way without attracting eBay's attention. I do wonder if ebay would really bother though as they would miss out on their fee if they pulled it out. |

I’m actually against the selling of bottles and boxes that are empty. That’s how the counterfeiters get them. And Macallan is regularly faked.
The eBay sales for Folio 5 are massively overpriced. Plus, sales of alcohol this way leaves you open to prosecution for selling without a licence. It’s up to £20k fine. The only way to avoid this is use an auctioneer. |

ebay dont spot them it is done when somebody reports them i have been told at least two people need to do this
i used to sell many years ago on ebay before we had all the auctions sites we have now i think bonhams mctears and christies were the only one availiable at the time and about twice a year
when i first started selling on ebay it was because there were plenty of whisky bottles on there so i didnt see a problem
after mine were taken down i learned why you couldnt sell on ebay so stopped selling on ebay but people still do and will still do so in the future nothing will change
and skottydog is correct about empty bottles but its all legal |

Unfortunately, this is the easiest way to recreate a fake whisky as all the bottle, packaging and labels will be genuine. All you need to fake is the capsule.
NEVER buy booze like this from eBay as you don’t know what you are getting and there is no comeback.
Secondly, the sale of alcohol in the UK through eBay is not legal, unless you have a personal licence and a premises licence as laid down by law. This is covered by the Licencing (Scotland) act 2005 or the Licencing Act (2003) for England and Wales. The max penalty is £20,000 in Scotland, and since 2015 has become unlimited in England and Wales. Bit extreme and probably wouldn’t apply in this case but you have to prove you checked for age etc...
I don’t understand why they didn’t sell through an auction site. The fees are minimal. |

Totally agree with the comments here, selling used bottles should be banned, I know as I purchased a fake that had been re filled years ago.
You can buy whisky from Europe on ebay but make sure they accept paypal as paypal does offer you some protection.
Do not buy from anyone who only offers bankers draft, you will get nothing back that way,
Generally I think ebay and in particular ebay Germany are a disgrace for allowing alcohol sales without the option of protection via paypal payment, they have actively encouraged fraudsters with that loophole by not insisting that paypal is offered, _________________ Pour me a glass please. |

I once bought a bottle of armagnac. It was the last one, so the retailer also gave me the factice display bottle.
The two were absolutely identical.
The only differences on the factice was a "factice" sticker (which was peelable) and the absence of a UK stamp which could have been added (from any old bottle) in seconds. |
